James McIvery, the 79-year-old Fort Lauderdale man who allegedly shot a 12-year-old kid in the abdomen a few weeks ago, was released from jail last night on his own recognizance, pending his trial.

McIvery told the cops on August 7 that a few youngsters had knocked on his door at an apartment in the 700 block of NW 12th Terrace multiple times and that he told the kids to leave him alone.

Fort Lauderdale cops say that at one point, McIvery came out of his apartment with a small revolver and fired two shots at the ground -- one of which struck the 12-year-old kid.

McIvery told detectives he fired the gun to scare off the kids and didn't intend to actually shoot any of them.

The kid was taken to Broward General Medical Center for emergency surgery, and police say he's now in stable condition, despite the fact that the bullet is still reportedly lodged in his abdomen.

McIvery was arrested by Fort Lauderdale cops without incident.

McIvery has been charged with aggravated battery with a firearm and was previously being held in the Broward County Jail without bond before yesterday's hearing.
